1. Acceptance of Terms
By accessing or using TraceDock ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
2. Description of Service
TraceDock is an uptime monitoring software-as-a-service (SaaS) platform that allows users to monitor the availability and performance of their websites, APIs, and online services. The Service includes features such as:
- Automated uptime checks at configurable intervals
- Real-time status dashboards
- Incident detection and alerting via email
- Public status pages for your users
- Uptime history and reporting
3. Account Registration
To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. TraceDock is not liable for any loss arising from unauthorized access to your account.
4. Subscription and Billing
TraceDock offers both free and paid subscription plans. The free plan includes limited features and monitor capacity. Paid plans unlock additional features, higher monitor limits, and faster check intervals.
All payments are processed securely through Stripe. TraceDock does not directly store your credit card information. By subscribing to a paid plan, you authorize Stripe to charge your payment method on a recurring basis.
Cancellation: You may cancel your subscription at any time through the billing section of your dashboard or via the Stripe customer portal. Upon cancellation, your paid features will remain active until the end of your current billing period. After that, your account will revert to the free plan. No refunds are provided for partial billing periods.
5. Acceptable Use
You agree not to use the Service to:
- Engage in any illegal, fraudulent, or harmful activity
- Monitor websites, servers, or services that you do not own or have explicit authorization to monitor
- Attempt to disrupt, overload, or interfere with the Service or its infrastructure
- Use the Service to conduct denial-of-service attacks or similar activities against third parties
- Violate the rights of others, including intellectual property rights
We reserve the right to suspend or terminate accounts that violate these acceptable use policies.
6. Service Availability
TraceDock strives to maintain high availability of the Service. However, we do not guarantee 100% uptime. The Service may be temporarily unavailable due to scheduled maintenance, upgrades, or circumstances beyond our control, including but not limited to network outages, infrastructure failures, or force majeure events.
We will make reasonable efforts to notify users in advance of any planned downtime. TraceDock shall not be held liable for any damages arising from Service interruptions.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in the Privacy Policy.
8. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable.
You may delete your account at any time through the settings page. Upon account deletion, your data including projects, monitors, incidents, and check history will be permanently removed from our systems.
9. Limitation of Liability
To the maximum extent permitted by applicable law, TraceDock and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. TraceDock does not warrant that the Service will be uninterrupted, error-free, or completely secure.
In no event shall our total liability exceed the amount you have paid to TraceDock in the twelve (12) months preceding the event giving rise to the liability.
10. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the changes taking effect. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
